Terms of service

These Terms and Conditions (“Terms”) are between Bubico Pty Ltd (ABN 13 689 459 372) (“Bubico”, “we”, “our” or “us”), and you (“you”, “your”), and govern your use of the Bubico online store and website located at www.bubico.com.au (the “Site”), as well as our related social media platforms and any other services we provide (collectively, the “Services”). These Terms also apply to your purchase of any products made available through our Site (“Products”).

1. Acceptance

By accessing or using our Site or purchasing Products from us, you agree to be bound by these Terms, including our Privacy Policy.
If you do not agree with these Terms, you must immediately cease using the Site.

  • contains viruses or harmful code; or

  • promotes spam, fraud, or illegal activity.

We may remove or edit any User Content at our discretion.

  • keep your login details confidential.

You are responsible for all activity under your account. Notify us immediately at support@bubico.com.au if you suspect unauthorised use of your account.

Prices are displayed in Australian Dollars (AUD) and include GST where applicable.

8. Availability and Cancellations

All Products are subject to availability.
We may cancel your order before delivery if:

  • an item is out of stock;

  • there is an error in pricing or product description; or

  • an event beyond our control prevents fulfilment.

If your order is cancelled, you will receive a full refund or may choose store credit or backorder.

9. Price and Payment

Payment must be made in full at checkout before your order is dispatched.
We accept the payment methods listed on our Site.
You must not make payments using fraudulent or unauthorised methods.

We reserve the right to change prices, shipping costs, or promotions at any time.

10. Promotional Codes

From time to time, we may issue promotional discount codes.
Each code is subject to the specific terms stated at the time of issue and must be applied during checkout to be valid.

11. Delivery, Title, and Risk

We deliver both within Australia and internationally.
Delivery times are estimates only and may vary depending on the courier.
Title to Products passes to you once full payment has been received.
Risk passes upon delivery to the address you provide.

We are not responsible for deliveries to incorrect or incomplete addresses supplied by you.

12. Warranty

Our Products come with guarantees that cannot be excluded under the Australian Consumer Law (ACL).
You are entitled to a replacement or refund for major faults and to have goods repaired or replaced if they fail to be of acceptable quality.

14. Limitation of Liability

To the fullest extent permitted by law:

  • our liability for any claim relating to the Products will not exceed the amount paid for the relevant order; and

  • we are not liable for indirect, consequential, or special losses, including loss of profits, data, or goodwill.

Nothing in these Terms limits your statutory rights under the ACL.

15. Intellectual Property

All intellectual property rights in the Site, Products, Content, and design elements belong to Bubico or our licensors.
You may not reproduce, copy, or use any of our intellectual property without prior written consent.

16. Termination

We may suspend or terminate your access to the Site or your account if you breach these Terms or engage in unlawful or inappropriate behaviour.
